This volume critically discusses the relationship between democracy and constitutionalism. It does so with a view to respond to objections raised by legal and political philosophers who are sceptical of judicial review based on the assumption that judicial review is an undemocratic institution. The book builds on earlier literature on the moral justification of the authority of constitutional courts, and on the current attempts to develop a system on "weak judicial review". Although different in their approach, the chapters all focus (...) on devising institutions, procedures and, in a more abstract way, normative conceptions to democratize constitutional law. These democratizing strategies may vary from a radical objection to the institution of judicial review, to a more modest proposal to justify the authority of constitutional courts in their "deliberative performance" or to create constitutional juries that may be more aware of a community's constitutional morality than constitutional courts are. The book connects abstract theoretical discussions about the moral justification of constitutionalism with concrete problems, such as the relation between constitutional adjudication and deliberative democracy, the legitimacy of judicial review in international institutions, the need to create new institutions to democratize constitutionalism, the connections between philosophical conceptions and constitutional practices, the judicial review of constitutional amendments, and the criticism on strong judicial review. In this article it is defended that the notion known as “The mark of the cognitive” is better characterized as a process that performs the function of generating intelligent behavior, in a flexible and adaptive way, capable of adapting to circumstances, given it is a context sensitive process. For that, some relevant definitions of cognition are examined. In the end, it is pointed out that the definition of the mark of cognition as a context-sensitive process takes into account several factors (...) that were added as constitutive parts of cognitive phenomena over the years, especially the 4E Cognition, which cannot be satisfactorily accommodated alongside the preceding notions of cognition. Accordingly, this essay shouldn’t be mistaken merely as an exercise in intellectual history, but as a brief and accessible attempt to advance the debate. (shrink)

The Turing test has been studied and run as a controlled experiment and found to be underspecified and poorly designed. On the other hand, it has been defended and still attracts interest as a test for true artificial intelligence (AI). Scientists and philosophers regret the test’s current status, acknowledging that the situation is at odds with the intellectual standards of Turing’s works. This article refers to this as the Turing Test Dilemma, following the observation that the test has been under (...) discussion for over seventy years and still is widely seen as either too bad or too good to be a valuable experiment for AI. An argument that solves the dilemma is presented, which relies on reconstructing the Turing test as a thought experiment in the modern scientific tradition. It is argued that Turing’s exposition of the imitation game satisfies Mach’s characterization of the basic method of thought experiments and that Turing’s uses of his test satisfy Popper’s conception of the critical and heuristic uses of thought experiments and Kuhn’s association of thought experiments to conceptual change. It is emphasized how Turing methodically varied the imitation game design to address specific challenges posed to him by other thinkers and how his test illustrates a property of the phenomenon of intelligence and suggests a hypothesis on machine learning. This reconstruction of the Turing test provides a rapprochement to the conflicting views on its value in the literature. (shrink)

Iowa Gambling Task (IGT) is one of the most widely used tools to assess economic decision-making. However, the research tradition on aging and the Iowa Gambling Task (IGT) has been mainly focused on the overall performance of older adults in relation to younger or clinical groups, remaining unclear whether older adults are capable of learning along the task. We conducted a meta-analysis to examine older adults’ decision-making on the IGT, to test the effects of aging on reversal learning (45 studies) (...) and to provide normative data on total and block net scores (55 studies). From the accumulated empirical evidence, we found an average total net score of 7.55 (± 25.9). We also observed a significant reversal learning effect along the blocks of the IGT, indicating that older adults inhibit the prepotent response towards immediately attractive options associated with high losses, in favor of initially less attractive options associated with long-run profit. During block 1, decisions of older adults led to a negative gambling net score, reflecting the expected initial pattern of risk-taking. However, the shift towards more safe options occurred between block 2 (small-to-medium effect size) and blocks 3, 4, 5 (medium-to-large effect size). These main findings highlight that older adults are able to move from the initial uncertainty, when the possible outcomes are unknown, to decisions based on risk, when the outcomes are learned and may be used to guide future adaptive decision-making. Turing’s much debated test has turned 70 and is still fairly controversial. His 1950 paper is seen as a complex and multilayered text, and key questions about it remain largely unanswered. Why did Turing select learning from experience as the best approach to achieve machine intelligence? Why did he spend several years working with chess playing as a task to illustrate and test for machine intelligence only to trade it out for conversational question-answering in 1950? Why did Turing refer to (...) gender imitation in a test for machine intelligence? In this article, I shall address these questions by unveiling social, historical and epistemological roots of the so-called Turing test. I will draw attention to a historical fact that has been only scarcely observed in the secondary literature thus far, namely that Turing’s 1950 test emerged out of a controversy over the cognitive capabilities of digital computers, most notably out of debates with physicist and computer pioneer Douglas Hartree, chemist and philosopher Michael Polanyi, and neurosurgeon Geoffrey Jefferson. Seen in its historical context, Turing’s 1950 paper can be understood as essentially a reply to a series of challenges posed to him by these thinkers arguing against his view that machines can think. Turing did propose gender learning and imitation as one of his various imitation tests for machine intelligence, and I argue here that this was done in response to Jefferson's suggestion that gendered behavior is causally related to the physiology of sex hormones. In 1950, Alan Turing proposed his iconic imitation game, calling it a ‘test’, an ‘experiment’, and the ‘the only really satisfactory support’ for his view that machines can think. Following Turing’s rhetoric, the ‘Turing test’ has been widely received as a kind of crucial experiment to determine machine intelligence. In later sources, however, Turing showed a milder attitude towards what he called his ‘imitation tests’. In 1948, Turing referred to the persuasive power of ‘the actual production of machines’ rather than (...) that of a controlled experiment. Observing this, I propose to distinguish the logical structure from the rhetoric of Turing’s argument. I argue that Turing’s proposal of a crucial experiment may have been a concession to meet the standards of his interlocutors more than his own, while his construction of machine intelligence rather reveals a method of successive idealizations and exploratory experiments. I will draw a parallel with Galileo’s construction of idealized fall in a void and the historiographical controversies over the role of experiment in Galilean science. I suggest that Turing, like Galileo, relied on certain kinds of experiment, but also on rhetoric and propaganda to inspire further research that could lead to convincing scientific and technological progress. Ronald Dworkin’s philosophy of law, in its mature version, is grounded in at least two central claims: first, a thesis about law and morality, which we might call the One-System Thesis; second, a thesis about how moral and legal propositions can be said to be true or false, which we might call the Interpretive Thesis. While the One-System Thesis holds that law and morality form a single system, the Interpretive Thesis makes two distinct claims: first, truth of interpretive propositions—such as (...) moral and legal propositions—must be established from within the practice in which they figure; second, the soundness of an interpretive proposition is related to the purpose of the practice under consideration. Mark Greenberg’s Moral Impact Theory of Law accepts the One-System Thesis while rejecting the Interpretive Thesis. The Moral Impact Theory is a metaphysical theory of how moral facts rationally determine the content of the law. Its main contention is that the actions of legal institutions have an impact on the moral obligations people have in a polity, and the content of the law is made up of the moral obligations that result from the actions of such institutions. Greenberg assumes that moral facts pre-exist and have some metaphysical priority in relation to legal facts. Moral facts must be prior and independent from legal practice in order to play a part in the rational determination of the content of the law. The point of this paper is to offer a response to Greenberg. I argue that the One-System Thesis only should be supported if the Interpretive Thesis is correct, and that without the latter the former becomes an implausible version of natural law jurisprudence. Jair Bolsonaro, the current President of Brazil, has made himself into one of the most influent advocates of COVID-19 denial. His health policy and his political doctrine are partly based on an implicit moral claim, which is neglected by contemporary political theory. Bolsonarism’s rhetoric raises a moral claim to freedom without responsibility, which relieves its followers from the burdens that emerge from liberal accounts of liberty or from basic goods accepted in a political community. In opposition to liberal or communitarian (...) accounts, Bolsonarism endorses a Hobbesian concept of freedom that describes it as the absence of ‘impediments to motion’. Nonetheless, it differs from Hobbes because it treats this liberty as endowed with moral value and non-negotiable through a social contract. (shrink)

All papers address the challenge of the construction of a Global Ethics in the context of fragmented and pluralist societies, in which the idea of an Ethical Space seems to be an unachievable project, but also an indispensable device for cooperation between individuals, communities and states.The idea of a Global Ethics is to be constructed from within different traditions and environments with a mutual understanding and exchange (...) of opinions. In this volume, we combine the ideas of Harmony (typical of the traditional Chinese legal philosophy) and of the Rule of Law (as it is understood in Western societies) to new ideals. By acknowledging the potential that these ideals have on a global scale, the papers of the first section, Ethical Dimensions of the Rule of Law address some of the key ethical problems in today's world. ¿Puede la tesis del reemplazo de Raz sobrevivir en el contexto de una teoría dworkiniana del derecho y de la adjudicación? Judging Positivism, de Margaret Martin, fornece una de las mejores reconstrucciones y una de las más interesantes críticas ya planteadas contra la influyente filosofía del derecho de Joseph Raz. En uno de los pasos centrales de su argumento, Martin desafía una sumisión central de Raz, que es el intento de combinar la tesis del reemplazo con la tesis de la (...) justificación normal. Mientras la primera exige que ciudadanos y oficiales excluyan de la deliberación cualesquiera razones de primer orden para la acción, la ultima invita consideraciones sobre legitimidad que no se puede examinar con independencia de las razones de primer orden que la tesis del remplazo pretende excluir. En este comentario crítico, yo acepto la crítica de Martin según la cual esas dos tesis no pueden ser aceptadas como argumentos conceptuales. Sin embargo, sugiero que aún existe un espacio para armonizarlas si se las acepta por razones normativas. Si hay un buen argumento para tratar razones jurídicas como un nivel intermedio de razones para la acción, entonces puede haber buenos argumentos circunstanciales para tratar razones institucionales como remplazantes en el sentido que Raz defiende en su teoría del derecho. Turing made strong statements about the future of machines in society. This article asks how they can be interpreted to advance our understanding of Turing’s philosophy. His irony has been largely caricatured or minimized by historians, philosophers, scientists, and others. Turing is often portrayed as an irresponsible scientist, or associated with childlike manners and polite humor. While these representations of Turing have been widely disseminated, another image suggested by one of his contemporaries, that of a nonconformist, utopian, and radically progressive (...) thinker reminiscent of the English Romantic poet Percy B. Shelley, has remained largely underexplored. Following this image, I will reconstruct the argument underlying what Turing called (but denied being guilty of) his “Promethean irreverence” (1947–1951) as a utopian satire directed against chauvinists of all kinds, especially intellectuals who might sacrifice independent thought to maintain their power. These, Turing hoped, would eventually be rivaled and surpassed by intelligent machines and transformed into ordinary people, as work once considered “intellectual” would be transformed into non-intellectual, “mechanical” work. I study Turing’s irony in its historical context and follow the internal logic of his arguments to their limit. I suggest that Turing genuinely believed that the possibilities of the machines he envisioned were not utopian dreams, and yet he conceived them from a utopian frame of mind, aspiring to a different society. His ever-learning child machines, whose intelligence would grow out of their own individual experiences, would help distribute power. (shrink)

Benzodiazepines and antidepressants have been shown to change responses to unfairness; however, the effects of their combined use on unfairness evaluation are unknown. This study examines the effects of concomitant benzodiazepines and antidepressants long-term use on the evaluation of fair and unfair offers. To analyze behavioral changes on responses to unfairness, we compared the performance of medicated participants and healthy controls in the Ultimatum Game, both in the proposer and in the respondent role. The results showed that long-term psychotropic users (...) had the worse economic strategy by accepting less offers than control subjects. However, in the proposer role, the unfair offers made by participants were similar between groups. The present results suggest that long-term use of psychotropic medication, specifically the combination of benzodiazepines and antidepressants, may increase the sensitivity to unfairness, resulting in higher rejection rates in conditions where this strategy is the most disadvantageous. It deals with a number of general argument types and their particular use in legal argumentation. It provides detailed analyses of argument from authority, argument ad hominem, argument from ignorance, slippery slope argument and other general argument types. Each of these argument types can be used to construct arguments that are sound as well as arguments that are unsound. To evaluate an argument correctly (...) one must be able to distinguish the sound instances of a certain argument type from its unsound instances. It is well known that Aristotle’s Metaphysics presents historians with many problems of literary history. The fourteen books of "first philosophy" available today did not originally form one single work which Aristotle himself planned and authored. This work as we have it is rather the result of a compilation after its author’s death. His disciples have joined together different writings which reflect their master’s teaching at different points in his career. Consequently, historians are confronted with problems of chronology, both absolute (...) and relative, with respect to each of the parts they distinguish in our version of the Metaphysics. One’s understanding of Aristotle’s thought and of the development of his teaching depends in large part on the solution to these problems. (shrink)

The commemoration of the 700th anniversary of the canonization of Thomas Aquinas (1225-1274) as well as the fiftieth anniversary of the death of Jacques Maritain (1882-1973) present an opportunity to re-examine the neo-Thomism of the contemporary French philosopher. Our aim here will be to set out the philosophical argument from which Maritain establishes an inseparable link between human rights (i.e., the dignity of the human person) and natural law. We will thus seek to expose how Maritain supports democracy from (...) the horizon of Christian philosophy. In doing so, the Thomistic democracy that Maritain proposes will appear to be distant from both totalitarian collectivism and anarchistic individualism, two current threats to the establishment of an authentic and mature democracy. This paper presents a solution to the problem of personal identity over time in Thomas’s metaphysics. I argue that Professor Gracia’s solution to the problem of personal identity, existence, and Professor Stump’s solution, form or the human soul, are not only compatible but also necessarily interdependent on one another. This argument rests on (1) the special nature of the human soul, and (2) the metaphysical claim that for Thomas the human soul and existence are inseparable. First, I refine (...) the problem of personal identity and briefly clarify some important distinctions. Second, I present Gracia’s arguments for the principle of existence (esse) being the criterion of personal identity over time in Thomas’s metaphysics. Third, I explain Stump’s arguments for form being the principle of personal identity over time in Thomas’s metaphysics, and show how Stump’s solution can answer some of the objections that Gracia presents. Finally, I argue that, according to Thomas, the soul of an individual human person and that person’s existence embrace one another with the strength of self-identity, and that it is correct and not inconsistent to say that both the human soul and existence are the cause and principle of personal identity over time in the metaphysics of Thomas. This contribution to a symposium on Samantha Frost’s Lessons from a Materialist Thinker considers her innovative reinterpretation of Thomas Hobbes’s philosophy, situating him as a precursor of New Materialism. Frost’s reading emphasizes Hobbes’s conception of human beings as ‘thinking bodies’ inextricably intertwined with their environment. This materialist conception leads to a relational, peace-oriented ethic rooted in our interdependence. Frost’s interpretation is contrasted with those of Arash Abizadeh and Stephen Darwall. Abizadeh identifies two normative dimensions in Hobbes’s ethics: the prudential (...) and the juridical. This perspective highlights the role of contractual obligations, which is less prominent in Frost’s interpretation. Darwall’s projectivist interpretation suggests that Hobbes saw ethical judgments as projections of our desires onto the world, which potentially challenges Frost’s materialist reading. While acknowledging the tensions between these interpretations, it is argued that Frost’s reinterpretation offers valuable insights for addressing contemporary ethical and political challenges. Neste artigo defendo que a Teoria da Informação Fortemente Semântica de Floridi – TIFS – está correta ao assumir a Tese da Veracidade, que por sua vez orienta a definição de informação semântica como “p é informação se e somente se p é constituído por dados bem-formados, com significado e verdadeiros”. Argumento que a teoria não é arbitrária, pois dá conta do desembaraço de conundrums filosóficos importantes, principalmente por evitar o paradoxo de Bar-Hillel e Carnap, que é gerado a partir (...) da teoria clássica da informação semântica. Primeiro é discutido um dos principais resultados da teoria clássica, o de produzir “sentenças muito informativas para serem verdadeiras”. Depois são resumidas as motivações para a elaboração de uma “lógica de estar informado” e é mostrado como o sistema KTB-IL é montado e modelado mantendo-se entre os seus axiomas o da veracidade – K ou A4. Finalmente, a TIFS é examinada e defendida ao mostrar que ela restringe aleticamente a extensão do conceito clássico de informação para evitar problemas com tautologias e contradições. A TIFS oferece uma solução original ao capturar nossas intuições modais a respeito da informatividade como noção básica. (shrink)

Les seules preuves philosophiques de l’existence des substances séparées qui répondent aux exigences épistémologiques de Thomas sont des arguments aristotéliciens dont les conclusions, basées sur des prémisses d’une astronomie et une physique obsolètes, sont inacceptables. Thomas prit des distances à leur égard et, laissé sans alternative philosophique, proposa une série d’arguments théologiques dont la cohérence et valeur logique sont mis en question. As the basis for this translation, Robb has used the Latin text of the Quaestiones de anima which he edited in 1968. Since both the English version and the Latin text are responsibilities of the same scholar, should the former be judged by the quality of the latter? This approach does not seem fair, especially since Robb did not present his original text as a critical edition, but rather as a "corrected" edition, designed to serve students of medieval philosophy until (...) the Leonine Commission published its definitive text. In fact Robb's edition achieved its goal very well, and has been an excellent tool for many studies of Thomas's anthropology. However, our analysis of the whole tradition of Quaestiones de anima has revealed two facts unknown to Robb: first, that the manuscript he used for his edition, although excellent, represents a late stage in the transmission of the text; and second, that the independent family, whose existence Robb was able to establish, is both larger than Robb thought and more authoritative than the university tradition. We hope to prove these points in the edition we are preparing for the Leonine Commission, which will differ from Robb's Latin text in many details. Given these conditions, we shall here limit ourselves to examining Robb's translation with respect to two questions: is it faithful to the text of Robb's Latin edition? and in what sense does it represent an improvement over this edition? This work presents a proposal for the characterization of the UnconfinedCompressive Strength test, through a series of operations that can be carried outwithout inconvenience in the field. Initially, fresh rock samples are obtained from outcropsin the area and specimens of specific dimensions are made. After the test specimenelaboration phase, crushing and granulometric classification tests are carried out witha set of specimens and in parallel with a second group, UCS tests are carried out. With theresults, the rock is characterized by graphing (...) granulometric curves and in this graph theareas of fine granulometry are focused, inserting in these areas, the average value of UCS,with which it can be identified and determined when it is really necessary and It is inevitableto send rock samples to laboratories, thus saving time and money for the mining project. Este artigo propõe considerações sobre o conceito de experiência [Erfahrung] a partir do texto Experiência e Pobreza, de Walter Benjamin, publicado em 1933, no qual o intelectual alemão desenvolve argumentos relacionados à experiência e à cultura observando o desenvolvimento tecnológico a partir da modernidade do século XIX, e sugere que haveria um “empobrecimento da experiência”, fazendo referência ao que chama de “cultura de vidro”. Articula-se essa leitura ao que tem sido chamado de “cultura de telas” - momento em que a (...) tecnologia exige contato permanente com as telas dos dispositivos eletrônicos que se tornam, cada vez mais, extensões do corpo e da mente humanos.
